Facility Rules & Code of Conduct


To ensure a safe, welcoming, and effective environment for all participants, The WorQue Shop,
LLC has established the following Facility Rules and Code of Conduct.
By entering the facility, you agree to comply with all rules and understand that failure to do so
may result in suspension or termination of membership, denial of entry, or other consequences as
determined by The WorQue Shop and its owner(s).
General Rules
 Check-in is required upon entry. Unauthorized access is prohibited.
 Proper athletic attire must be worn at all times, including closed-toe athletic shoes. No
jeans, work boots, or open-toe footwear allowed in workout areas.
 No profanity, aggression, or harassment of any kind toward staff, members, or guests
will be tolerated.
 Members and guests must wipe down equipment after each use using the cleaning
products provided.
 All personal belongings must be kept in designated areas (lockers or cubbies). Bags
are not permitted on gym floors.
 No food or glass containers are allowed in workout areas. Only water or sports drinks in
sealed bottles are permitted.
 Respect the time limits on equipment, especially during peak hours.
 No unauthorized training or instruction is allowed. Only The WorQue Shop-approved
personal trainers may offer instruction on the premises.
 All children under 18 must be under direct supervision of a parent, guardian, or
authorized trainer at all times (see Minor Policy).
 Members and guests must follow all posted signs, policies, and staff instructions.
Acknowledgment
By using this facility, I acknowledge and agree to follow all rules of conduct as outlined above. I
understand that violations may result in the suspension or cancellation of my access to the
facility.

2. Equipment Use & Safety Disclaimer
The WorQue Shop, LLC
The equipment and workout areas at The WorQue Shop, LLC are provided for the benefit of all
members and guests. Use of this equipment is at your own risk. The following policies govern its
use:

Use Guidelines
 Members and guests are expected to use equipment only for its intended purpose.
 If you are unfamiliar with how to properly use any machine or free weights, it is your
responsibility to ask a staff member or certified trainer for assistance.
 Do not use any equipment that appears broken, damaged, or malfunctioning. Report any
issues immediately to staff.
 Dropping or slamming weights is prohibited unless in designated lifting zones and with
approved equipment.
Assumption of Risk
By using the equipment provided by The WorQue Shop, I understand and acknowledge that:
 I am voluntarily participating in physical activity that may involve risk of injury or
illness.
 I am solely responsible for knowing my own limitations and physical condition and for
operating equipment safely.
 I release The WorQue Shop, LLC, its owner(s), staff, trainers, contractors, and affiliates
from any and all liability related to injuries, damages, or medical conditions resulting
from my use of any equipment or participation in any physical activity at the facility.

3. Waiver of Liability for Lost, Stolen, or Damaged Property
The WorQue Shop, LLC
The WorQue Shop, LLC, its owner(s), and affiliated personal trainers are committed to
providing a safe and professional environment for all members and guests. However, the facility
is not responsible for any personal property that is lost, stolen, or damaged while on the
premises, including but not limited to within the facility, parking areas, or adjacent property.
Property Disclaimer
 Members and guests are solely responsible for their personal belongings, including but
not limited to phones, wallets, keys, bags, clothing, jewelry, and electronic devices.
 Personal items should not be left unattended at any time. Lockers and cubbies are
provided for temporary use, but they do not guarantee security.
 Items left overnight may be removed and stored or discarded at the sole discretion of The
WorQue Shop staff.
Vehicle and Parking Lot Disclaimer

 The WorQue Shop is not responsible for the loss, theft, or damage of any
vehicle or contents left inside a vehicle while parked in or near the facility.
 This includes break-ins, vandalism, accidents, or theft of or from any vehicle on or
near the premises, including any designated or overflow parking areas.
 Parking is at your own risk. Members and guests are encouraged to lock their vehicles
and remove valuables.
Acknowledgment
By entering or using the facilities or parking areas of The WorQue Shop, LLC, I hereby waive
and release The WorQue Shop, its owner(s), staff, contractors, personal trainers, and affiliates
from any and all liability or claims related to the loss, theft, or damage of personal belongings or
vehicles, whether due to negligence, criminal activity, or any other cause.

4. Photo and Video Release Consent
The WorQue Shop, LLC
By entering the premises of The WorQue Shop, LLC, participating in any event, class, training
session, or activity, I acknowledge and agree to the following:
 I grant full permission to The WorQue Shop, LLC, its owner(s), staff, contractors, and
affiliates to capture, use, and distribute my image, likeness, voice, and appearance in
photographs, video recordings, and digital media taken during activities in the facility or
at off-site events hosted by The WorQue Shop.
 These materials may be used for lawful promotional, advertising, educational, or
commercial purposes across all media platforms including, but not limited to, websites,
social media, print, and digital advertising, without compensation to me.
 I understand that I may opt out of photography or filming by notifying management in
writing prior to participation in any class or session. However, I understand that group or
background appearances may still occur unintentionally.
 I release The WorQue Shop, LLC, its owner(s), staff, and affiliates from any liability or
claims related to the use of such media.

5. Cancellation & Refund Policy
The WorQue Shop, LLC
By enrolling in a membership, class, or program with The WorQue Shop, LLC, I acknowledge
and agree to the following cancellation and refund policy:

Membership and Service Cancellation:
 Members may cancel their membership or recurring services by submitting written notice
(email or in-person) at least 14 days (two weeks) prior to their next billing date.
 Cancellations received less than 14 days before the next billing cycle may result in an
additional charge before cancellation takes effect.
 Cancellation requests must include the member’s full name, contact information, and
reason for cancellation.
Refund Policy:
 All payments are final. No refunds will be issued for any reason, including but not
limited to missed sessions, non-attendance, or dissatisfaction with services.
 Prepaid packages, personal training sessions, and class passes are non-refundable and
non-transferable.
 Exceptions may be made only at the sole discretion of The WorQue Shop, LLC, and
only in the case of verifiable medical emergencies or permanent relocation beyond a 25-
mile radius, supported by documentation.

6. Personal Training & Coaching Disclaimer
The WorQue Shop, LLC
Personal training and coaching services offered by or through The WorQue Shop, LLC are
designed to support physical health, fitness, and performance. By engaging in these services, you
agree to the following:
 I understand that personal trainers and coaches affiliated with The WorQue Shop are not
licensed medical professionals and cannot diagnose, treat, or cure medical conditions.
 I acknowledge that I am responsible for consulting a physician before beginning any
fitness program, especially if I have any known or suspected health conditions, injuries,
or limitations.
 I understand that participation in training programs may involve physical exertion, the
use of fitness equipment, and risk of injury.
 I release The WorQue Shop, LLC, its owner(s), personal trainers, and affiliates from
any liability for injuries, illness, or adverse outcomes that may result from my
participation, including but not limited to strains, sprains, or exacerbation of existing
medical conditions.
 I agree to disclose any known medical conditions, recent surgeries, pregnancy, or
physical limitations to my trainer before beginning any program. Failure to do so does
not make The WorQue Shop or its affiliates liable for any resulting injury or health event.

7. Minor Policy & Parental Consent
The WorQue Shop, LLC
To ensure the safety of all members, staff, and guests, the following policy applies to minors
(individuals under the age of 18) at The WorQue Shop, LLC:
General Policy for Minors:
 Unattended or unauthorized minors are not permitted on the premises at any time.
 Minors under the age of 18 may only access the facility with a parent or legal guardian
present, unless actively engaged in a supervised class or session with a designated
personal trainer.
 All minors must have a Minor Waiver and Parental Consent Form completed and
signed by a parent or legal guardian prior to entry or participation in any activity.
Parental Consent & Waiver of Liability:
 By signing the Minor Waiver, the parent/guardian acknowledges that The WorQue Shop
is a physical fitness environment with potential risks.
 The parent/guardian agrees to assume full responsibility for the safety and supervision of
the minor while on-site unless under direct instruction of a trainer.
 The parent/guardian releases The WorQue Shop, LLC, its owner(s), staff, and personal
trainers from any and all liability for injury, illness, or other incidents involving the
minor, including known or unknown medical conditions and risks related to exercise
participation, up to and including death.

8. COVID-19 and Infectious Disease Disclaimer
The WorQue Shop, LLC
The health and safety of our members, guests, and staff is a top priority. By entering The
WorQue Shop, LLC and participating in any classes, training sessions, or facility use, you
acknowledge and agree to the following:
Assumption of Risk:
 I understand that COVID-19, other infectious diseases (including but not limited to
influenza, RSV, or norovirus), and communicable illnesses may be spread through
airborne transmission, surface contact, or close personal interaction.
 I acknowledge that despite all reasonable efforts by The WorQue Shop, LLC, its
owner(s), and staff to provide a clean and safe facility, there is an inherent risk of
exposure to infectious diseases in any public or group setting.

Personal Responsibility:
 I agree not to enter the facility or participate in any activities if I am experiencing
symptoms of COVID-19 or any contagious illness, have tested positive within the past 5
days, or have been advised by a medical professional to self-isolate or quarantine.
 I agree to follow all posted guidelines, including sanitization, mask usage (if
applicable), and distancing protocols as set forth by The WorQue Shop.
Liability Waiver:
 I voluntarily assume all risks related to exposure or infection from COVID-19 or any
other communicable or infectious disease.
 I hereby release and hold harmless The WorQue Shop, LLC, its owner(s), staff,
personal trainers, contractors, and affiliates from any and all claims, liabilities, damages,
losses, or expenses, including medical expenses, hospitalization, or death, related to or
arising from exposure to or contraction of any infectious disease while on the premises or
participating in any services.

9. TCPA & SMS/Email Marketing Consent
The WorQue Shop, LLC
By providing your contact information to The WorQue Shop, LLC, including but not limited to
your mobile number and email address, you acknowledge and consent to receive
communications as described below, in accordance with the Telephone Consumer Protection
Act (TCPA) and other applicable laws.
Consent to Receive Marketing Communications
 I expressly consent to receive marketing, promotional, and transactional
communications from The WorQue Shop, LLC, its owner(s), affiliates, and authorized
service providers via:
o Text message (SMS/MMS)
o Email
o Phone calls (live or automated)
 These communications may include, but are not limited to: promotions, class updates,
appointment reminders, schedule changes, policy notices, event invitations, and
membership-related information.
Implied Consent & Information Sharing
 By voluntarily providing my contact information (phone, email, or other), I acknowledge
that this constitutes implied consent to receive such communications.

 I understand and agree that The WorQue Shop, LLC may share my information with
authorized third-party vendors (such as CRM platforms, scheduling tools, marketing
services, and payment processors) solely for the purposes of communication, membership
management, and service delivery.
Standard Carrier Disclaimer
 Message and data rates may apply. I understand that standard rates for text messaging
or data usage may be charged by my mobile carrier, and I am solely responsible for
those charges.
Opt-Out Instructions
 I may opt out of marketing communications at any time by:
o Replying STOP to any SMS message received, or
o Sending an email request to [insert your email address here], or
o Filling out a digital opt-out form, if available through The WorQue Shop
website or app.

Note: Opting out of marketing communications will not prevent The WorQue Shop from sending
transactional or legally required messages (e.g., payment confirmations or safety notices).
Waiver of Liability
 I waive and release The WorQue Shop, LLC, its owner(s), affiliates, and authorized
third parties from any claims arising from my receipt or non-receipt of such messages,
including accidental or delayed communications, and understand that communication
services are not guaranteed.
